1. Acceptance of Terms

By accessing or using any part of RecruitMyGame (the “Service”), including creating an account, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy, which is incorporated herein by reference. If you do not agree to all of these Terms, do not access or use the Service.

These Terms constitute a legally binding agreement between you and RecruitMyGame, LLC (“RecruitMyGame,” “we,” “us,” or “our”). We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice on our platform at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

2. Age Requirements and Parental Consent

Minimum Age: You must be at least 13 years old to create an account or use the Service. By using the Service, you represent and warrant that you are at least 13 years of age.

Users Under 18: If you are under 18 years of age, you represent that you have obtained parental or legal guardian consent to use this Service and to the collection and use of your personal information as described in our Privacy Policy. We strongly encourage parents and guardians to be involved in the creation and management of accounts for minors.

Users Under 13 — COPPA: We do not knowingly collect personal information from individuals under 13 years of age. If we learn that we have collected personal information from a child under 13 without verifiable parental consent as required by the Children’s Online Privacy Protection Act (“COPPA”), we will promptly delete that information. If you believe we may have collected information from a child under 13, please contact us immediately at privacy@recruitmygame.com.

Users Under 16 (California): Pursuant to the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), we will not sell or share the personal information of users we know to be under 16 years of age without affirmative opt-in consent. For users 13–15, opt-in consent must be provided by a parent or legal guardian.

3. Service Description

RecruitMyGame is an athlete recruiting platform that allows student-athletes to create comprehensive digital profiles showcasing their athletic achievements, academic performance, character, and availability to college coaches and recruiters. Our services include, but are not limited to:

• Athlete profile creation and management
• Photo and video hosting (subject to plan storage limits)
• Schedule and availability tracking, including optional calendar integrations
• Digital business card and QR code generation
• Coach review and testimonial system
• Awards, achievement, and academic record display
• NIL (Name, Image, Likeness) readiness tools
• Coach discovery and outreach features
• JUCO Transfer Portal access (via separate subdomain and terms)

RecruitMyGame is an independent platform and is not affiliated with, endorsed by, or operated in conjunction with the NCAA, NAIA, NJCAA, any conference, league, or educational institution. We do not guarantee recruitment, scholarship offers, or admission to any institution.

4. User Accounts and Security

To access most features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to immediately notify us of any unauthorized use of your account at support@recruitmygame.com.

You may not create more than one account per person, share your account credentials with others, create accounts using automated means, or create accounts on behalf of another person without their prior written consent.

5. User Responsibilities and Acceptable Use

By using the Service, you agree to:

• Provide accurate, truthful, and current information in your profile and communications
• Keep your login credentials secure and confidential
• Comply with all applicable local, state, federal, and international laws and regulations
• Respect the privacy and rights of other users
• Maintain professional and respectful conduct in all platform interactions
• Use the Service solely for lawful purposes related to athletic recruiting and talent discovery

Prohibited Conduct

You may not:

• Upload, submit, or distribute false, misleading, defamatory, obscene, or unlawful content
• Impersonate any person, coach, school official, or organization
• Misrepresent academic credentials, athletic performance, or personal identity
• Upload content that infringes third-party intellectual property, privacy, or other rights
• Harvest or collect contact information of other users without their consent
• Use the Service to send unsolicited commercial communications (spam)
• Attempt to gain unauthorized access to any part of the Service or its systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts, bots, or scrapers to access the Service
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to violate any athlete’s FERPA rights or educational data privacy
• Share another user’s personal information without authorization

6. NCAA, NAIA, and Eligibility Compliance

Student-athletes are solely responsible for ensuring that their use of RecruitMyGame complies with all applicable eligibility rules of the NCAA, NAIA, NJCAA, or any other athletic governing body to which they are subject. RecruitMyGame makes no representations and accepts no liability regarding whether use of this platform affects your amateur status, eligibility, or compliance with any governing body’s rules.

NIL (Name, Image, Likeness): The use of NIL-related features on this platform is subject to the rules of your applicable governing body and your educational institution. You are solely responsible for ensuring NIL activity complies with current rules. RecruitMyGame is not a party to any NIL agreement and assumes no liability for NIL transactions or their effects on eligibility.

We are not affiliated with, endorsed by, or acting as an agent of the NCAA, NAIA, NJCAA, or any educational institution.

7. Content Ownership and License

Your Content: You retain ownership of all content you upload, submit, or post to RecruitMyGame (“User Content”), including photos, videos, statistics, and profile information.

License to Us: By submitting User Content, you grant RecruitMyGame a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, distribute, display, and perform your User Content solely for the purpose of operating, improving, and promoting the Service. This license does not affect your ownership rights.

Public Profiles: If you set your profile to public, you acknowledge that coaches, recruiters, scouts, and other visitors may view, screenshot, or share your publicly visible profile content. You retain the right to set your profile to private at any time.

Coaches and Verified Users: Coaches and verified staff who submit reviews or testimonials grant RecruitMyGame a license to display those testimonials as part of the athlete’s profile.

Content Removal: We reserve the right to remove any User Content that violates these Terms, applicable law, or that we determine in our reasonable judgment to be harmful, offensive, or inappropriate. We will generally notify you before removal unless immediate action is required.

8. Intellectual Property Rights

All content, features, and functionality of the Service that is not User Content — including but not limited to the RecruitMyGame name, logo, software, design, text, graphics, and interface — is owned by RecruitMyGame, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works from our proprietary content without our express written permission. The RecruitMyGame name and logo may not be used without our prior written consent.

9. Subscription and Billing

RecruitMyGame offers free and paid subscription plans. By selecting a paid plan, you authorize us to charge your payment method on a recurring basis at the billing interval you select (monthly or annually) until you cancel.

Pricing: All prices are in US dollars. We reserve the right to change subscription pricing with at least 30 days’ advance notice to existing subscribers.

Auto-Renewal: Paid subscriptions automatically renew unless you cancel at least 24 hours before your renewal date. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date.

Refund Policy: You may request a refund within 7 days of your initial purchase or annual renewal. Refunds are not provided for monthly subscriptions after use of the billing period has begun except as required by applicable law. Refund requests must be submitted to billing@recruitmygame.com.

Payment Processing: All payment transactions are processed securely by Stripe, Inc. Your payment information is transmitted directly to Stripe and is not stored on RecruitMyGame servers. Use of Stripe is subject to the Stripe Connected Account Agreement.

Failed Payments: If a payment fails, we will notify you and provide a grace period to update your payment method. Continued failure to pay may result in downgrade to the free plan or account suspension.

10. Disclaimers and No Guarantee of Recruiting Outcomes

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

No Guarantee of Recruiting Success: RecruitMyGame does not guarantee, promise, or represent that use of the Service will result in recruitment, scholarship offers, walk-on opportunities, college admission, or any other recruiting outcome. Recruiting decisions are made solely by coaches and institutions. We make no representations about the effectiveness of our platform for any particular athlete.

Coach Representations: RecruitMyGame does not verify the identity or authority of all coaches or recruiters who access athlete profiles. You interact with coaches at your own risk. We are not responsible for the conduct of coaches or institutions.

Uptime: We do not guarantee uninterrupted or error-free operation of the Service. We may perform scheduled or emergency maintenance that temporarily impacts availability.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RECRUITMYGAME, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, SERVICE INTERRUPTIONS, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless RecruitMyGame, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to (a) your violation of these Terms; (b) your User Content; (c) your use of the Service; (d) your violation of any third-party right, including privacy, intellectual property, or publicity rights; or (e) any fraud or misrepresentation made by you.

13. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes in detail how we collect, use, disclose, and protect your personal information, including your rights under the California Consumer Privacy Act (CCPA/CPRA), GDPR, and other applicable privacy laws.

By using the Service, you consent to our data practices as described in the Privacy Policy.

14. Third-Party Services and Links

The Service may contain links to or integrations with third-party websites, applications, and services (including but not limited to Google, Stripe, Hudl, and social media platforms). RecruitMyGame does not endorse and is not responsible for the content, privacy practices, or availability of third-party services.

Your use of third-party services is governed by those services’ own terms and privacy policies. We encourage you to review the terms and privacy policies of any third-party services you use.

15. Termination

By You: You may close your account at any time from your account settings or by contacting us at support@recruitmygame.com. Upon account closure, your profile will be deactivated and your personal data will be handled in accordance with our Privacy Policy.

By Us: We reserve the right to suspend or terminate your account, with or without notice, for any violation of these Terms, for activity that we reasonably believe poses a risk of harm to us, other users, or third parties, or for any other reason in our sole discretion. We will generally provide notice before termination unless we determine immediate action is required.

Upon termination for cause, no refund of prepaid subscription fees will be issued. Sections of these Terms that by their nature should survive termination will survive, including Sections 7, 8, 10, 11, 12, 16, 17, and 18.

16. Dispute Resolution and Binding Arbitration

Informal Resolution: Before initiating any legal proceedings, you agree to first contact us at legal@recruitmygame.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If informal resolution fails, you and RecruitMyGame agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except for claims that qualify for small claims court. The arbitration will be conducted in English on a confidential basis. The arbitrator’s decision will be final and binding.

Class Action Waiver: YOU AND RECRUITMYGAME AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If a court finds this waiver unenforceable for a particular claim, that claim must be severed from arbitration and litigated in court.

Opt-Out: You may opt out of the binding arbitration agreement by notifying us in writing within 30 days of first accepting these Terms at legal@recruitmygame.com. Opting out does not affect any other part of these Terms.

17. Governing Law and Jurisdiction

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. To the extent that arbitration does not apply or is found unenforceable, you consent to the exclusive personal jurisdiction of the state and federal courts located in Texas for the resolution of any such disputes.

18. Force Majeure

RecruitMyGame shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riot, civil unrest, embargoes, acts of civil or military authority, fire, flood, earthquake, natural disaster, pandemic, epidemic, strikes, labor disputes, failure of third-party services or infrastructure (including internet outages, hosting provider failures), or government orders.

19. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy and any supplemental terms for specific features (including the JUCO Portal Terms), constitute the entire agreement between you and RecruitMyGame regarding the Service.

Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Notices: We may provide notices to you via email, in-platform notification, or by posting to recruitmygame.com. All required notices to us must be sent to legal@recruitmygame.com.
